Tattered Hope and Shattered Judiciary

Lois Mcmaster had once said ” The dead cannot cry out for justice it is the duty of the living to do so for them”.

This very quote forced me to write after so long and reminded me of the incident that happened today where 4 accused were shot dead point blank in the early morning. Long story short, they were accused of having committed rape with a veterinarian and have burned her after this incident.

While this henious incident surely shakes the collective conscience of the society and by no means acceptable to any civilized society, the Killing of four accused alleged to have committed this crime in the name of encounter also doesn’t holds good. It’s disastrous on so many fronts.

My simple question is :-

How does anyone know whether those four were the real culprits or not?

Did the police had conducted proper investigation of their involvement in the crime?

If the investigations were not done and no one testified that they were the real culprits on what basis did the police shot them ?

And the much bigger question is, don’t they had the right to legal representation?

We are the country, ladies and gentlemen where we can give legal representation to terrorists like Ajmal kasab and Yakub menon despite having a concrete proof and bunch of eye witnesses but we cannot give representation to those who were alleged only of committing this incident.

According to the NCRB report,2017 there has been an increase of 6% in the cases against women and 7% increase in the cases of rape so it has been clearly evident from the above mentioned fact that legally we have failed to contain the crime.

If we have considered our constitution as the supreme law of the land and have so much faith in our judicial proceedings then with what authority do these policemen shot them dead ? It not only undermines our judicial establishment but also forces general audience to shaken their faith on the judiciary. If this is not a populist measure then I have no idea what is because I’m quite certain in my belief that it is certainly not a deliverance of justice.

In case, even if I believe that they were the real culprits, then on what ground this gives police the right to shoot them down?

As a student who have studied law extensively and as a civil service aspirant I utterly condemn this act where disregard have been caused to the Judiciary and where the persons were denied the right to legal representation. Remember, an individual is innocent until proven guilty and this is how a judiciary of a democratic society concisely works.

There must be initiation of an in-depth enquiry on the policemen involved and the supreme court should take cognizance as soon as possible.

As a society we have a moral responsibility to uphold the constitutional values and this immoral policing by Cyberabad police should be dealt upon.
